法律英語 | 閱讀難懂的英文案例 三部曲讓你「有跡可循」

作為法律人，我們不免會借鑒一些外文案例，當翻開滿書都是英文字母的16k合訂本時總有一種無從下手的感覺。即使是使用搜索引擎查詢，想要從萬千案例中尋找到心儀的那一篇，也沒有那麼容易。

其實，閱讀案例並沒有想像的那麼難，它也是有跡可循的，只要找對方法。下面審判君就為你送上案例閱讀3部曲。

第一部分

了解案例的組成部分

1. 案例名稱（Case Name）

例：Marbury v. Madison （馬伯里訴麥迪遜），其中「 v」 是單詞「versus」的縮寫，即「訴」的意思。

2. 判決法院（Court rendering the opinion）

例：New Jersey Supreme Court （新澤西最高法院）。

3. 卷宗號；案號（Citation）

例：93 N.J324, 461 A. 2d 138 （1983），這說明該案出自《新西彙編》第93卷，第324頁，以及《大西洋彙編》第二輯第138頁，該案判決於1983年。此處，「A」 是「Atlantic Reporter」的縮寫。像這種指明兩個或兩個以上出處的卷宗號叫作：「平行卷宗號」，其英語表達為「parallel citation」，意思是「An additional reference to a case that has been reported in more than more reporter.」

4.主審法官姓名（Justice wrote the opinion）

5. 判決書 （opinion）：判決書是整個案例的主體部分，其中包括法律爭議（Issue）、雙方當事人情況、事實經過、判決採用的相關法律以及判決結果。

判決書的閱讀過程之中，要注意以下幾點：

1. 現在主審法官的意見用現在時態；前審法院的意見用過去時態。

2. 主審法官的意見是法院意見。

3. 除法院意見外還有兩種意見，它們被稱為「反對意見」（dissenting opinion or dissent）與「配合意見」（concurring opinion）。「反對意見」指不同意大多數法官判決結論之某一法官的意見； 「配合意見」是指同意大多數法官的意見，但是不同意判決結論的推理之某一法官的意見。

6.法庭投票（Votes of the court）

例如在七名大法官審理的情況下，有幾名法官的意見是「維持原判」（affirmance），有幾名法官的意見是「撤銷原判、發回重審」（reversal and remandment）。

第二部分

了解什麼是卷宗號(citation)

由於卷宗號這一塊涉及內容龐雜，這裡再逐一特別說明一下。我們首先來看一下《布萊克法律字典》中citation的定義：A reference to a legal precedent or authority, such as a case, statute, or treatise, that either substantiates or contradicts a given position. （p.237） 7th edition. 由於a citation is a reference to a legal authority，因此，citation必須要有一個標準，這樣以後的參考者才容易檢索得到。

案例之中的卷宗號通常包括下列幾個部分：

a. 案件雙方當事人姓名（the names of the parties involved in the lawsuit）；

b. 包含案件全文的彙編卷號（the volume number of the reporter containing the full text of the case）；

c. 該案例彙編的縮寫名稱（the abbreviated name of that case reporter）；

d. 案例開始的頁碼數（the page number on which the case begins）；

e. 案件判決年份（the year the case was decided）；

f. 案件判決法院（the name of the court deciding the case）（有些會出現有些不會）。

例: Hebb v. Severson, 201 P.2d 156 （Wash. 1948）.

在這個例子當中，Hebb是原告（plaintiff），Severson 是被告（defendant）。我們可以在《太平洋彙編》第二輯201卷第156頁（volume 201 of the Pacific Reporter Second Series beginning on page 156）找到這一案例。該案是由華盛頓州最高法院（Washington State Supreme Court）於1948年判決的。

第三部分

如何閱讀案例之中的卷宗號（citation）

首先確定卷宗號之中的縮略碼。請對照下列列表，找出縮略碼（abbreviation）的彙編全稱（full reporter title）.

表示：摩根訴美國，收集在美國案例彙編第298卷，468頁開始；最高法院案例彙編第56卷906頁開始；美國最高法院案例彙編律師版第80卷，1288頁開始，1936年判決。

例2：

The official citation for this Supreme Court decision is:

There are several different publishers for legal documents such as court decisions. （Libraries usually only carry one of these published versions.） These publishers may be referred to in parallel citations for this case.
